RENTAL AGREEMENT This Short-Term Rental Agreement, entered into as of the acceptance date of this reservation, is made by and between Owner and Renter for "Blackrock Escape" (hereafter “Property”; address as detailed in confirmed reservation). Owner and Renter acknowledge that this rental agreement is available for review on the booking platform, acknowledge that they will comply with the terms of this agreement, and each assumes the responsibility for the obligations set forth herein. By making a reservation, Renter acknowledges that they have read, accept, and agree to be bound by the terms of this rental agreement and that Renter and Renter’s guests will abide by the House Rules. TERM: The term of the lease shall begin on the reservation arrival date and end on the reservation departure date. The property will be ready for occupancy no earlier than 4pm on the check-in date in the reservation, and must be vacated no later than 10am on the check-out date in the reservation. RENTAL RATE AND FEES: The rental rate and associated fees shall be as agreed to in the reservation on the applicable booking platform. LIMITED OCCUPANCY: The rental party shall be limited to the number listed on the rental reservation. Occupancy is limited to a maximum of four guests. If Owner concludes that this policy has been breached, the Owner reserves the right to expel the entire party with no refund. NON-DISTURBANCE CLAUSE: Renter and their guests shall not disturb, annoy, endanger, or inconvenience neighbors nor use the premises for any unlawful purposes. CARE OF PREMISES/DAMAGES: Renter agrees to pay Owner for any damages to furnishings, household items, or hot tub that occur as a result of Renter’s occupancy. This will include payment of any additional reasonable cleaning charges incurred due to Renter’s occupancy. OWNERS RIGHTS: Renter agrees that if the conditions and limitations set forth herein are not met, Owner shall have the right to cancel this agreement and may enter the Property, either by statutory proceedings or by force, to inspect the Property and ensure that Renter has vacated the Property. All monies paid by Renter shall be forfeited as liquidated damages. INDEMNITY CLAUSE: Renter hereby agrees to Indemnify and hold Owner harmless from any and all claims, including those of third parties, arising out of or in any way related to Renter’s use of Property or the items of personal property provided therein. Renter assumes all risk of injury or other losses relating to any recreational activities, including use of the private hot tub on the Property, and will hold Owner harmless with respect thereto. NO SUBLETTING: Renter may not sublet or assign this lease for all or any part of the premises without prior written consent of the Owner. REPAIRS AND MAINTENANCE: The Property is rented with the Owner’s furniture and household furnishings. Owner shall not be responsible for providing additional furnishings or equipment not presently available in Property. Renter will report any maintenance issues immediately to the Owner. Owner will make every effort to repair and/or replace any equipment that is not working properly, but cannot guarantee that all equipment is in good operating order at all times and no rate adjustments or refund will be made for equipment or appliance failures. HOUSE RULES: a. No smoking, vaping. or e-cigarettes allowed b. No parties c. Quiet hours from 10 pm – 8 am d. Dogs allowed (up to 2, with a fee per dog as posted on the listing platform) e. Renters and their guests must abide by the posted hot tub safety rules CHECK OUT PROCEDURES: a. CHECK-OUT NO LATER THAN 10AM (unless late check out is approved by Owner). b. All furniture should be returned to its original location. c. Turn off lights and appliances. d. Load dirty dishes in dishwasher and start dishwasher. e. Remove and dispose of all food items from refrigerator. f. Take all trash to dumpster located at intersection of Blackrock Circle and Blackrock Drive. The attic storage area (accessed via the spiral staircase) is not available to guests. Certain Resort amenities are not available to anyone renting through Airbnb. There is no guest access to The Aquatics + Fitness Center (indoor pool/fitness center), Devil's Knob golf course (on the mountain), Devil's Grill, or the Racquet Sports Facilities. The Resort does not currently offer day passes for purchase. (Note: Please contact Wintergreen Resort directly with any questions regarding access to specific Resort amenities.) Seasonal resort activities (available for an additional fee) include: skiing, The Plunge Tubing Park, The Spa at Wintergreen, Discovery Ridge Adventure Center, The Treehouse, Stoney Creek golf course (in the valley), and on-site dining. Access to Lake Monocan (Sun, Mon, Wed, Thu, and Fri) is available for a fee. There are also a number of great hiking trails in/around Wintergreen. Guests have free access to Chestnut Springs outdoor pool from 2pm - close daily (between Memorial Day and Labor Day) .
